Terms of Service

These Terms of Service ("Terms") govern your use of Journery (the "Service"), a travel-organization platform provided and operated by its creators located in Peru ("Journery", "we", "us"). Please read them together with our Privacy Policy.

1. Acceptance of these Terms

By creating an account or using the Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.

Beta / Closed Testing: The Service is currently in a closed beta testing phase. It is provided for personal testing and evaluation purposes only, to a closed group of invitees. Features may be modified, limited, or discontinued at any time without notice. Paid tiers and commercial subscriptions are not currently active or being sold.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country) and able to form a binding contract to use the Service.

3. Your account

You sign in through Google. You are responsible for all activity under your account and for keeping access to it secure. Notify us promptly of any unauthorized use.

4. Acceptable use

You agree not to:

  • use the Service in violation of any law or third-party right;
  • upload another person's personal data without a lawful basis or their consent;
  • attempt to disrupt, overload, reverse-engineer, scrape, or gain unauthorized access to the Service;
  • misuse AI features to generate unlawful, harmful, or abusive content; or
  • resell or commercially exploit the Service without our written permission.

5. Your content

You retain ownership of the trip content you create. You grant us a worldwide, non-exclusive license to host, store, process, and display that content solely to operate and improve the Service — including transmitting it to the third-party providers described in the Privacy Policy (such as AI and mapping providers). You are responsible for the content you upload and for whom you share it with, including via trip invitations and public share links.

6. AI features

The Service includes AI-generated features (day organizer, place suggestions, budget estimates, receipt scanning, travel insights). All AI-generated content and suggestions are produced automatically by third-party artificial intelligence engines (such as Google Gemini). We do not control, verify, edit, or guarantee the accuracy, safety, reliability, or appropriateness of AI suggestions. AI output may be inaccurate, incomplete, outdated, or incorrect. Use of and reliance on any AI suggestions is entirely at your own risk. Journery, its creators, and operators assume no responsibility or liability for any actions taken, travel arrangements made, financial decisions executed, or damages/losses incurred as a result of relying on AI-generated suggestions. Verify all important details (such as operating hours, locations, safety conditions, and pricing) independently with official sources before relying on them.

7. Not a travel agency or travel agents

Journery is a software application designed solely to help you organize and plan your travel. We are not a travel agency, tour operator, or professional travel agents. We do not sell, resell, bundle, or arrange travel services, flights, accommodations, tours, or transport. We do not act as an agent for any traveler or travel provider. Any travel bookings, reservations, or arrangements you make are done directly with third-party providers, and we are not a party to those transactions. We provide no professional travel advice, recommendations, or assurances.

8. Credits and paid plans

The Service uses virtual "credits" and tiered plans to meter certain AI features. Credits have no cash value, are not redeemable for money, and are non-transferable except as expressly provided in the app. During the closed testing phase, virtual credits are provided to users at no cost for testing purposes only. We reserve the right to limit, modify, or revoke credits at any time. Pricing, billing, and paid tiers will be introduced in the future, and their terms will be finalized and updated here before any paid plans launch.

9. Third-party services

The Service depends on third-party providers (including Google, Supabase, and others). We are not responsible for their availability, performance, or acts, and their terms may also apply to your use.

10. Service availability and changes

We may add, change, suspend, or discontinue any part of the Service at any time. We aim for high availability but do not guarantee uninterrupted access.

11. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the maximum extent permitted by law.

12. Limitation of liability

To the maximum extent permitted by law, Journery will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability arising out of or relating to the Service will not exceed USD 50 (or its equivalent in Peruvian Soles).

13. Indemnification

You agree to indemnify and hold Journery harmless from claims arising out of your misuse of the Service or your violation of these Terms or applicable law.

14. Termination

You may stop using the Service and delete your account at any time from the Account page. We may suspend or terminate access if you violate these Terms or to protect the Service or other users.

15. Governing law

These Terms are governed by and construed in accordance with the laws of Peru, without regard to its conflict-of-law rules. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Lima, Peru.

16. Changes to these Terms

We may update these Terms from time to time. We will post the revised version with a new "Last updated" date and, for material changes, take additional steps to notify you. Continued use after changes take effect constitutes acceptance.
